Notwithstanding Glenn Reynolds’s reiterated admonition, an e-mail that I received today from the Democratic Senate Campaign Committee leads me to believe that the Dems themselves see their 2022 election prospects as nil and declining. Shrieking about the Supreme Court’s supposedly impending rejection of same-sex marriage, interracial marriage and contraception evidently is not enough to nudge the polls in the right (i. e., left) direction, so the DSCC wails this screed (all italics and boldface in the original):
ALERT: Experts warn that Social Security could be on the Supreme Court's chopping block
Team, by overturning Roe v. Wade, the Supreme Court just proved that NOTHING is safe from the conservative justices’ right-wing rampage.
In fact, experts warn that Social Security could be in danger, too. During her confirmation hearings, Amy Coney Barrett famously REFUSED to say if Social Security was constitutional – and if the Court strikes it down, 65 million Americans will LOSE the benefits they earned.
We can’t risk losing this bedrock of Americans' retirement, so we’ve launched an urgent Live Poll to PROVE that the American people support upholding Social Security – but we’re still short 37 responses in your area!
The “experts” consulted by the DSCC, whoever they may be, seem to believe that Social Security, like the right to abortion in Roe v. Wade, was created by the Supreme Court out of “emanations and penumbras” rather than by an act of Congress that was held, in the ordinary course of litigation, to fall within the enumerated powers of the legislative branch.
Next comes, I suppose, the warning that the Court is on the verge of deifying Donald Trump and commanding all citizens to sacrifice doves on his altar.
